JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 25-01-2016 Heard learned counsel for the petitioner. Despite repeated calls, none appears on behalf of the State. The petitioner seeks pre-arrest bail in connection with Kadwa P.S. Case No. 114 of 2015 registered under Sections 376 and 420 of the Indian Penal Code. It is contended that the FIR has been registered on the basis of a complaint which was sent to the police under Section 156(3) of the Code of Criminal Procedure for investigation. The allegations made in the FIR are absolutely false. It is further contended that even otherwise the allegations made in the FIR do not inspire any confidence.

Regard being had to the nature of the offence and the statement of the victim recorded under Section 164 Cr. P.C., in the event of arrest or surrender in the court below within six weeks from today, the petitioner, who is said to he a man of no criminal antecedent, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. Case No. 114 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
