JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks bail in connection with Sono P.S. Case No. 120 of 2017 registered for offences punishable under sections 272, 273 of the Indian Penal Code and Section 30(A) 41, 47 of Bihar Prohibition and Excise Act. Allegation against the petitioner is that 62 litres of foreign liquor were recovered from the vehicle of petitioner and the other co-accused fled away.

Learned counsel for the petitioner submitted that he has falsely been implicated in this case and has no criminal antecedent. The petitioner has been in custody for about two months.

Having heard both sides and considering the

Patna High Court Cr.Misc. No.34961 of 2017 (2) dt.03-08-2017 aforementioned facts and circumstances, let petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Jamui, in connection with Sono P.S. Case No. 120 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not adduce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
