Petitioner is accused in connection with Kahalgaon P.S. Case No. 412 of 2015 registered under Sections 363, 366A, 501 and 506/34 of the I.P.C.
The accusation is of kidnapping of Rancy Kumari, daughter of the informant by one Manish Kumar and others, including the petitioner.
Learned counsel appearing on behalf of the petitioner submits that petitioner is grand-father of the co-accused Manish Kumar, due to that reason, petitioner has falsely been implicated in this case. It is further submitted that the statement of the victim Rancy Kumari, has been recorded under section 164 Cr. P.C. in
Patna High Court Cr.Misc. No.56208 of 2015 (2) dt.15-12-2015 2/2 which she has stated about moving herself with co-accused Manish Kumar according to her sweet will and also stated nothing is in her memory about further incident. It is also submitted that petitioner is in custody since 01.10.2015, having no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Kahalgaon P.S. Case No.412 of 2015/G.R. No. 3683 of 2015.
