JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-09-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Forbesganj P.S. Case No. 243 of 2017 registered for the offence punishable under sections 147, 148, 149, 341, 342, 332, 333, 353, 427, 435, 188, 153A, 504 and 506 of the Indian Penal Code. Learned counsel appearing for the petitioners submits that the allegations levelled are general and omnibus. The present false case has been lodged against these petitioners only on account of political rivalry. During investigation nothing has come to suggest complicity of these petitioners in the alleged offence. No injury report is on the record.
Considering the facts and circumstances of the case and the
Patna High Court Cr.Misc. No.35071 of 2017(3) dt.18-09-2017 2/2 submissions of advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 243 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
