Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Khaira P.S. Case No. 325 of 2019 registered for offence punishable under sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code, 1860.

As per allegation, the present petitioner and co-accused Anil Ram assaulted the father of the informant with sword.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.1298 of 2022(2) dt.02-06-2022 2/3 that there is a land dispute between the parties. So far as the injuries sustained by the father of the informant are concerned, three injuries are simple in nature and one injury is grievous. He has also submitted that the petitioner is under custody since 24.08.2021.

Considering the above-mentioned facts and circumstances as well as the period of incarceration, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 325 of 2019, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
