Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The F.I.R. relates to an occurrence of robbery, allegedly, committed by unknown person. The petitioner is in custody since 04.03.2016.

Submission is that nothing has been recovered from the possession of the petitioner nor the petitioner was put on TI Parade. Only material is the confessional statement of the other accused person.

Learned Additional Public Prosecutor submits that the petitioner's figure has come in the CCTV camera at the time of commission of the crime alleged.

No.48126 of 2016 (3) dt.13-02-2017 2/2 Considering the aforesaid facts as well as the period already undergone by the petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar/successor Court in connection with Katihar (Town) Police Station Case No. 144 of 2016, subject to the condition that one of the bailors shall be a local resident having immovable property and another shall be a family member.
