2. Learned counsel for the petitioner has submitted that he may be permitted to do necessary correction in prayer portion of the petition within course of the day.
3. Permission accorded.
4. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 8(c) and 21(b) of the NDPS Act.
5. The case of the prosecution is that 5.06 gm. of smack was recovered from the possession of this petitioner.
6. Learned counsel for the petitioner has submitted that the petitioner is quite innocent and has falsely been implicated in this case due to village enmity. Learned counsel

No.62684 of 2025(3) dt.28-11-2025 2/2 for the petitioner has submitted that the contraband which has been recovered from the possession of the petitioner is just above small quantity and is much less than the commercial quantity. Learned counsel has lastly submitted that the petitioner is in judicial custody since 09.06.2025.
7. Learned Additional Public Prosecutor for the State has vehemently opposed the bail.
8. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Manihari P.S. Case No. 156 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II, Katihar.
