The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 184 of 2020 registered for the offences punishable under Sections 504, 506, 326, 307 and 34 of the Indian Penal Code read with Section 27 of the Arms Act. The learned senior counsel for the petitioner submits that the petitioner is in custody since 23.06.2021, charge-sheet has been submitted in the case and has antecedent of three cases. The learned counsel further submits that in the FIR it is alleged that the accused persons including the petitioner came to the house of the informant and this petitioner is alleged to have fired causing injury to Shobha Devi on her arm. The learned senior counsel submits that since the informant side and the petitioner side are agnates and are having land dispute as such cases after cases are being instituted against each of the parties, it is next submitted that even presuming what has been alleged is true without admitting for the purposes of bail then allegation is of firing causing injury on the non vital part of the body.

The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 23.06.2021, charge-sheet has been submitted in the case and the allegation of firing causing injury is on non vital part of the body, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor
