JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 324, 341, 332, 353, 379/34 of the Indian Penal Code.

The prosecution case is that the informant being the Chowkidar was going to perform duty when co-accused Bodha Rai caused injury to him by iron rod whereas the petitioner caused injury by lathi. The accused persons also snatched Rs. 7500/- from the informant.

It is submitted by learned counsel for the petitioner that since the informant's motorcycle collided with the petitioner leading to some hot exchange, hence malicious accusation has been levelled against him. A statement has been made in

Patna High Court Cr.Misc. No.56569 of 2015 (2) dt.14-12-2015 paragraph no. 3 that the petitioner has got no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia P.S. Case No. 03 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
