The petitioners are apprehending arrest in connection with Chanpatiya P.S. Case No. 189/2022 for the offence under Sections 304(B), 201 and 34 of the I.P.C. pending in the Court of learned C.J.M., Bettiah, West Champaran.

The prosecution story, in brief, is that the informant alleged that her sister was married to Sanjay Patel in 2021 but was being tortured for dowry and on the fateful day, she got knowledge about her killing as also cremation. Accordingly, the F.I.R.

Learned counsel for the petitioners submit that the

Patna High Court CR. MISC. No.65269 of 2022(2) dt.11-04-2023 2/2 petitioners herein three in number are brother, 'bhabhi' as also mother of Sanjay Patel, living separately and had nothing to do with the alleged occurrence.

It is his further submission that Sanjay Patel (husband) is in custody as stated in para 11 of the petition. Learned APP opposes the prayer for bail.

Taking into account the fact that there is omnibus allegation in the F.I.R., the husband, Sanjay Patel is in custody as stated in Para 11, the petitioners are family members and ultimately they will have to face the music, this Court is inclined to grant them the privilege of anticipatory bail. Let the petitioners be released on bail, in the event of their arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran, in connection with Chanpatiya P.S. Case No. 189/2022 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Rajiv Roy, J) Ravi/Kiran U T
