The petitioner apprehends his arrest in Khizarsarai P.S. Case No. 69/2016, registered for the offences punishable under Sections 153A, 353 and other sections of the Indian Penal Code.

The informant got confidential information that Md. Jawed of Village - Hemara constructed a new building and also stair in piling of his house, which caused difficulty in crossing the idol. The informant and others officially tried to pacify the mob that had assembled near Durga Asthan. The accused persons assembled having armed with different weapons they started damaging the stairs.

Patna High Court Cr.Misc. No.49544 of 2016 (3) dt.16-01-2017 2/2 Learned counsel for the petitioners submits that no specific allegation is made against the petitioners. Many other accused persons similarly situated have already been granted anticipatory bail.

Considering the facts aforesaid and the fact that no specific allegation is made against the petitioners and other accused persons similarly situated have been granted anticipatory bail, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 3rd, Gaya in connection with Khizarsarai P.S. Case No. 69/16, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
