Mrs. Anita Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-10-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The present petition has been filed for grant of regular bail on behalf of the petitioners in connection with Town P.S. Case No. 139 of 2019 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 120(B), 324, 307, 448, 504, 379, 354, 435, 436, 506 and 411 of the Indian Penal Code. The allegation is regarding 20 named and 50 unknown persons having assaulted the prosecution party and committed loot in the shop of the informant. The petitioners are stated to be non FIR named accused persons.

The learned counsel for the petitioners submits that

It is further submitted that the petitioners are languishing in custody since 22.06.2019. Lastly, it is submitted that similarly situated co-accused persons have already been granted bail vide order dated 13.09.2019 passed in Criminal Misc. No. 56924 of 2019.

Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioners, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Town P.S. Case No. 139 of 2019.
