That this is an application for issuance of an appropriate writ(s), order(s) or direction(s) to the respondents to remove the encroachment made by the respondents over the Raiyati land of the petitioners by constructing the

Patna High Court CWJC No.24169 of 2013(4) dt.24-07-2024 2/3 road under Minimum Guarantee Scheme in the year 2012- 13, between Chandi to Gopalpur Via Parari (Block-Chandi, Nalanda) without following the mandate of law as well as without giving any prior opportunity of hearing and further direct the respondents to act in accordance with the spirit of justice in relation to the case of the petitioners."

After some arguments, the learned counsel for the petitioners seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioners to approach the Collector, Nalanda at Biharsharif, for redressal of their aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioners approach the Collector, Nalanda at Biharsharif, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed off by passing a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter.
