Petitioners are accused in connection with Saharghat P.S. Case No. 58 of 2015 registered under Sections 406, 419, 420, 120(B)/34 of the I.P.C.

The accusation is that petitioners and Ram Udai Rai along with Baba Balak Das @ Dilip reached at the house of the informant Bhogi Sah where Baba Balak Das told to the informant that in his house, one side there is human bone and on the other side, there is Gold in the earth and all asked Rs. 1,50,000/- to remove the bone and extract the Gold. Thereafter, the informant handed over Rs. 1,50,000/- and later on, petitioner no.1 further

Patna High Court Cr.Misc. No.56328 of 2015 (2) dt.13-01-2016 2/2 asked the informant to give Rs. 1,00,000/- more for removing the same from the house at which, the informant called them and they came on 13.08.2015 at his house to collect the money, then the informant asked them to return the money then the aforesaid persons started to flee away but they were caught hold by the villagers and admitted their guilt to chit the informant. Learned counsel appearing on behalf of the petitioners submits that petitioners have falsely been implicated in this case. It is also submitted that petitioners have no criminal antecedent and are in custody since 14.08.2015. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Madhubani in connection with Saharghat P.S. Case No. 58 of 2015 corresponding to G.R. No. 43 of 2015.
