The petitioner seeks bail in a case registered for the offence under Sections 302, 120(B), 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., on the order of this petitioner, all the accused persons, named in the F.I.R., opened fire from their respective pistols upon the husband of the informant, due to which, he died on the spot.

It is submitted on behalf of petitioner that from perusal of F.I.R., it is apparent that this petitioner is order-giver. Allegation of firing is against other co-accused and petitioner is in custody since 15.02.2021.

However, learned counsel for the State and informant

Patna High Court CR. MISC. No.1483 of 2022(2) dt.22-03-2022 2/2 opposed the bail petition and submitted that petitioner is not only order-giver, but has also actively participated in the alleged occurrence, in which, husband of the informant died. Considering the aforesaid facts and circumstances as well as the fact that petitioner is only alleged to be order-giver and has remained in custody for more than one year, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Jamui in connection with Chandradeep P.S. Case No. 177 of 2020.
