JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-08-2017 The petitioner seeks regular bail in connection with Town P.S.Cae No.345 of 2017 registered for offences punishable under Sections 325, 307, 302, 506 and 201/34 of the Indian Penal Code.

Allegation against the petitioner is of assault to three years daughter of the informant by 'lathi'.

Submission of the learned counsel for the petitioner is that the whole prosecution case is false and concocted and further it is submitted that the petitioner has been falsely implicated in this case on the basis of land dispute. It is alleged that the petitioner has assaulted by 'lathi' and the postmortem report shows that no external injury found on the person of the dead-body rather the fact is that the deceased died due to illness and there was enmity

Patna High Court Cr.Misc. No.35148 of 2017 (2) dt.04-08-2017 2/2 between the parties so he has falsely implicated the petitioner in this case and she is in custody for 2 1⁄2 months. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in connection with Town P.S.Case No.345 of 2017. With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reason, her bail bond shall be cancelled.
