====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-09-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 308(2), 303(2), 329(3), 352, 351(2) (3), 3(5) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, these two petitioners demanded extortion and took out Rs. 20,000/- from the pocket of informant. It is further alleged that earlier also these petitioners had threatened the informant.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Present

Patna High Court CR. MISC. No.64360 of 2025(2) dt.16-09-2025 2/2 case is counter blast of Nokha petitioners 161 of 2025 which was lodged by petitioner no. 2 against informant and his family members in which petitioner no. 1 sustained head injury and after lodging of the aforesaid case, this false and concocted case has been lodged. Both parties are co-villagers. Rest of the allegations are ornamental and super addition.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and case and counter case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-cum-Sub Judge I, Rohtas at Sasaram in connection with Nokha P. S. Case No. 162 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
