JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-01-2017 Heard the parties on the application for anticipatory bail filed by the petitioner in connection with Parsa Bazar P.S.Case No.163 of 2016 G.R. No.5666 of 2016 for the offence under Section 414 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner has been named on the basis of suspicion only, showing that there is hand of the petitioner in theft of the A.C. and other articles. Other than the above, there is no material available against the petitioner and the petitioner has clean antecedent.

Heard learned A.P.P. also, who has submitted that the investigation is in the initial stage, as such, at present the petitioner is not entitled for anticipatory bail. Having heard both sides. In view of the fact that there is

No.53521 of 2016 (2) dt.19-01-2017 suspicion against the petitioner only and the investigation is still continuing, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of.
