The petitioner seeks bail in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner and there is recovery from the mango orchard, which is admitted open place.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.07.2019 and has got one similar case of Bahadurpur P.S. Case No. 252 of 2019 which was

Patna High Court CR. MISC. No.66485 of 2019(3) dt.05-11-2019 2/2 Excise Act, in which he is on bail. The co-accused has been granted anticipatory bail by this Co-ordinate Bench of this Court in Cr. Misc. No. 21031 of 2019 dated 04.04.2019. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.JIInd-cum-Special Judge (Excise), Darbhanga, in connection with Bahadurpur P.S. Case No. 26 of 2019, corresponding to G.O. Case No. 65 of 2019.
