The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 156 of 2019, registered for the offence under Section 399/402/412 of the Indian Penal Code. As per prosecution case, on secret information that some miscreants have assembled to commit offence, raid was conducted and two accused were arrested with arm and they disclosed the name of this petitioner as the person who fled away from the place of occurrence after seeing police. It is submitted on behalf of the petitioner that no arms have been recovered from the possession of the petitioner and those co-accused who were apprehended on the spot with arms have been granted bail. Petitioner is in custody since

Patna High Court CR. MISC. No.699 of 2022(2) dt.21-03-2022 2/2 28.09.2021. It is further submitted that though petitioner is accused in four criminal cases but out of them in three cases, he is on bail.

Learned APP for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, East Champaran, Motihari, in connection with Kalyanpur P.S. Case No. 156 of 2019.
