JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner apprehends her arrest in connection with Kotwali P.S. Case No. 570 of 2019, registered under Sections 341, 342, 323, 354, 355, 406 and 420/34 of the Indian Penal Code.

The accusation is that on 26.06.2019 at about 8 P.M., informant, Rekha Modi, approached to the petitioner at residence White House, Budh Marg of Chand Bihari for clearance of cheque and returned her ornaments but on instruction of petitioner, wife of Chand Bihari, her 6-8 staffs attacked on informant catching her hand and damaged her mobile, out of whom, the informant knows to Mithilesh and

Patna High Court CR. MISC. No.59040 of 2019(2) dt.19-09-2019 2/2 Sunil. At that time, Chand Bihari and his son, Pankaj Agrawal came but in spite of her request, neither the ornaments nor the amount of cheque was returned to her.

Learned counsel for the petitioner submits that due to business rivalry, the informant who is also a businesswoman and cornice litigant, the present case has been lodged with false allegation, only to harass the informant and her family members. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No. 570 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
