SONI SHRIVASTAVA ORAL ORDER 12-09-2025 At the outset, learned counsel for the petitioners prays for withdrawal of the present anticipatory bail application on behalf of petitioner no. 3 as he has already died during the pendency of this application.

2. Accordingly, the application on behalf of petitioner no. 3 is dismissed as withdrawn as having become infructuous. The application only survives against the petitioner nos. 1 and 2.

3. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

4. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109(1), 303(2), 3(5) of the B.N.S.

5. The first information report discloses an allegation that when the informant went to his field for some work, he found the accused persons including the petitioners removing the boundaries of his field and upon objecting to the same, petitioner no. 2 Bablu Kumar tried to strangulate the father of the informant and pushed him on the ground while petitioner no. 1 Munnu Kumar assaulted by means of lathi.

Learned counsel for the petitioners submits that there was a dispute between the parties with regard to transaction of money and when the petitioners were demanding due money from the informant, they have been falsely implicated in the present case. The injury reports of the informant and his father have also been annexed as AnnexureP/3 series and the same would show that the injuries are in the nature of body pain etc. and thus simple in nature.

7. Learned APP for the State opposes the grant of anticipatory bail.

8. Taking into consideration the facts and circumstances and also considering that there was a dispute with regard to money transaction and the injured have received simple injuries, let the above named petitioners in the event of their arrest or surrender before the learned Court below within

No.62524 of 2025(2) dt.12-09-2025 3/3 a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Parasbigha P.S. Case No. 182 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
