JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 At the very outset, learned counsel for the petitioners has submitted that during pendency of this application, petitioner no. 1 has been taken into custody as such this application so far petitioner no. 1 is concerned, has become infructuous and he may be permitted to withdraw the same. Permission is accorded.

This application so far petitioner no. 1 is concerned, is dismissed as withdrawn So far other petitioners are concerned, they are apprehending their arrest in connection with Kasba P.S. Case No. 58/2019, disclosing offences under Sections 147, 148, 149,

Patna High Court CR. MISC. No.61876 of 2019(3) dt.08-01-2020 2/2 323, 341, 324, 325, 326 and 307 of the Indian Penal Code. Allegation against the petitioners and others is of assault to the informant and other family members. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and all the injuries were found simple in nature except one injury, which has been attributed to other accused person. Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, let the petitioners, above named, except petitioner no. 1, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Kasba P.S. Case No. 58/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This application is, accordingly, disposed of. (Vinod Kumar Sinha, J) sunilkumar/- U T
