JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks bail in connection with Mashrakh P.S. Case No. 362 of 2018, registered for the offences punishable under Sections 307, 34 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.

Prosecution case is that petitioner has taken the informant and thereafter shot him on his head, causing injury. Submission of learned counsel for the petitioner is that as a matter of fact informant has received gun shot injury in some other manner and he has falsely been implicated and he is in custody since 7.12.2018.

Heard learned APP, who has opposed the prayer for bail stating that informant is injured himself. In view of above facts and circumstances, I am not inclined to grant bail to the petitioner. However, since the

Patna High Court CR. MISC. No.58522 of 2019(4) dt.20-02-2020 2/2 petitioner is in custody for more than one year, learned court below is directed to expedite the commitment of the case and once committed, learned trial court is directed to expedite the trial.

Accordingly, this application is dismissed.
