The petitioner apprehends his arrest in connection with Pakribarawan P.S.Case No. 159 of 2015 registered for offences punishable under Sections 341, 323, 354, 504 and 506 of the I.P.C.

The prosecution case as per written information by one Ramashish Chouhan to the Station Head Officer, Pakribarawan P.S. alleging therein interalia that on 25.08.2015 at about 9.00 P.M., Sanjay Chauhan (petitioner) came near the house of informant and abused, on protest of sister of informant, accused petitioner Sanjay Chouhan assaulted the sister of informant by means of bricks on the leg and back.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.57723 of 2015 (2) dt.13-01-2016 2/2 petitioner that there is serious land dispute between the petitioner and the informant and both the petitioner's father and father of the informant are full brothers.

It has further been submitted that the petitioner has also lodged a case earlier against the informant and his family members bearing Pakri Barawan P.S.Case No. 34 of 2015 and the present case is a counter blast to the earlier case. The learned counsel for the petitioner stated that no injury has been found on the informant or his sister, rather the petitioner himself has been injured. It has further been stated that the petitioner has no criminal antecedent, which finds place at para-3 of this petition.

Be that as it may, let the above named petitioner in the event of his arrest or surrender before the Court below within a period of six weeks from today be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of Shri Niraj Kishore Singh, Judicial Magistrate, 1st Class, Nawada in connection with Pakribarawan P.S.Case No. 159/2015, subject to the conditions as laid down under Section 438(2) of the Cr.
