The petitioner seeks bail in connection with N.D.P.S. Case No. 93 of 2021, arising out of Paroo P.S. Case No. 250 of 2021, registered for the offence under Sections 399, 402, 414/34 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act.
As per prosecution case, one loaded country-made pistol and total cash of Rs. 10,000/- having stamped of SBI, Sheikhpura Branch and one motorcycle has been recovered from the possession of the petitioner.
It is submitted on behalf of the petitioner that no recovery has been made from the conscious possession of the petitioner. The recovered amount of Rs. 10,000/- and
Patna High Court CR. MISC. No.712 of 2022(2) dt.21-03-2022 2/2 motorcycle were not stolen rather belong to the petitioner. No narcotic substance have been recovered from the conscious possession of the petitioner and he is in custody since 15.07.2021.
Learned APP for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeVth, Muzaffarpur, in connection with N.D.P.S.
