2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 30(a), 36 of Bihar Prohibition and Excise Act.

3 As per FIR. it is a case of incriminating wine recovered from the outside of the house of the petitioner.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner has no concern with the alleged wine. The petitioner is in custody since 17.08.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.65536 of 2023(2) dt.13-10-2023 2/2 considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court of Excise, Patnacity in connection with Didarganj P.S. Case No. 257 of 2021.
