Petitioner apprehends arrest in connection with Rajpur P.S. (Dist Buxar) Case No. 101 of 2023 registered for the offence under sections 147, 149, 341, 323, 336, 188, 353, 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. Similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court vide order dated 21.07.2023 passed in Cr. Misc. No. 35190 of 2023, as contained in Annexure P-3. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.67566 of 2023(2) dt.19-10-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Rajpur P.S. Case No. 101 of 2023 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
