2. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 406/409/ 420 of the Indian Penal Code.

3. As per the prosecution case, this petitioner who was working as Chief Franchise In-charge of Regional office, Sahara India, Sitamarhi, during the period 2011-2017, committed financial irregularities and misappropriated huge amount of the complainants by making their forged signature.

4. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that petitioner is ready to pay 25% of the amount claimed by one of the

Patna High Court CR. MISC. No.981 of 2022(8) dt.17-07-2023 2/2 complainants, Kedar Nath Singh. Rest of the amount has been disputed by the petitioner. Petitioner has got clean antecedent.

5. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha PS case No. 52/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C. with further condition that at the time of furnishing bail bond the petitioner shall deposit 25% of the amount claimed by Kedar Nath Singh in the court below failing which the court below shall be at liberty to pass appropriate order. The amount so deposited by the petitioner shall be subject to final outcome of the case.
