JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This is an application for grant of anticipatory bail in connection with Aurangabad (Town) P.S. Case No. 157 of 2019, disclosing offences under Sections 341, 323, 307, 379, 447, 504, 34 of the Indian Penal Code.
As per F.I.R. there is allegation that petitioners came to the shop of the informant and one Arjun Yadav assaulted by rod to the informant, causing injury. There is general allegation against the petitioners that they have also assaulted and snatched away Rs.20,000/- from the shop.

No.59427 of 2019(2) dt.19-09-2019 2/3 Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against them, rather the specific allegation is against petitioner no.4. The injury report also shows that only two injuries over the person of the injured.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail and has submitted that there is general allegation against petitioner no.1 and so far petitioner no.2 is concerned, he is an accused in a excise case and petitioner no.4 is also accused in other cases. Having heard both sides, considering the antecedent of petitioner no.4, I am not inclined to grant privilege of anticipatory bail to him, he may surrender and pray for regular bail before the learned court below.
So far as, other petitioners are concerned, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Aurangabad, in connection with Aurangabad (Town) P.S. Case No. 157 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
