JUSTICE SUDHIR SINGH ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Sections 376D/34 of the Indian Penal Code read with Section 4 of the P.O.C.S.O. Act.
Allegation against the petitioner is that she enticed away the daughter of the informant and thereafter, other accused persons committed rape upon her.
It is submitted on behalf of the petitioner that she has got no criminal antecedent. She has been implicated in the present case due to village politics. The alleged occurrence is said to have taken place on 12.3.2015. F.I.R. was instituted on 18.3.2015. On behalf of the State, it is submitted that petitioner is named in the F.I.R. and there is specific allegation against her. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.
Any how, if petitioner surrenders in the court below, i.e., learned First Addl. Sessions Judge (Special Judge, POCSO), Bagaha, West Champaran, in connection with Ramnagar P. S.
Patna High Court Cr.Misc. No.58044 of 2015 (2) dt.10-03-2016 2/2 Case no. 43 of 2015 within a period of six weeks from today and prays for regular bail, same shall be considered and disposed of on its own merit without being prejudiced by this order. (Sudhir Singh, J) sudip/- U T
