JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 29-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code and Sections 66(b) and 66(c) of the Information Technology Act. It is a case of physically manipulating in the ATM machine by the petitioner and other accused persons. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits on the basis of confessional statement of apprehended co-accused, namely, Dhananjay Kumar and Dharmendra Kumar, the name of the petitioner came into light. He further submits that the petitioner has only associated to the

He further submits that no incriminating article, instrument and gazette recovered from the possession of the petitioner so it is clear that he has not participated in this offence. Petitioner has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Ghoshi P.S. Case No. 505 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
