Vide order dated 07.10.2023, counsel for the Bihar Staff Selection Commission submits that the basis of the claim of the petitioner as per his submission is the mark-sheet annexed as Annexure-1 to the writ petition before the Bihar Staff Selection Commission in which the percentage of marks has been mentioned as 78.50%, but counsel submitted on that date, that the application form and the marks which he has annexed in the writ petition are different and he offered to produce the original documents before the Court. In the light of his

Patna High Court CWJC No.2100 of 2018(6) dt.06-11-2023 2/2 submission made on 07.10.2023, he has produced the original documents before this Court by which it transpires that the submissions made by the counsel for the Bihar Staff Selection Commission is correct.

3. Learned counsel for the petitioner has also seen the original record of the Bihar Staff Selection Commission and submits that opportunity has been granted to him to file objection which he has filed online which has not been considered.

4. In this regard, the stand taken by the Bihar Staff Selection Commission that the original application filed by the petitioner itself was defective and it is due to this reason, the case of the petitioner has not been considered.

5. This Court finds that there is substance in the argument of the Bihar Staff Selection Commission, and hence, in this view of the matter, this writ petition is hereby dismissed. (Dr. Anshuman, J.) Divyansh/- U
