The petitioners apprehend their arrest in connection with C.A. Case no. 3106 of 2015, registered under Section 365 of the Indian Penal Code.
The accusation is that on 19.11.2015 petitioners, who are brother-in-law and sister-in-law, in relation, called Aftab Rai, son of the complainant for some work, but he did not return till night. When complainant made query about her son the petitioner abused her and her son is still traceless.
Learned counsel for the petitioners submits that, in fact, daughter of petitioner No.2 was kidnapped by the Aftab, son of the
Patna High Court Cr.Misc. No.53355 of 2016 (2) dt.16-12-2016 2/2 present complainant on 19.11.2015 regarding the same on the basis of the written report of petitioner No.2 Sangita Devi, Katihar Muffasil P.S. Case No. 134 of 2015, under Sections 363 and 366(A) of I.P.C. was instituted and when complainant came to know about the said case, she also lodged the present case after seven days of the occurrence.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Katihar in connection with C.A. Case No. 3106 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
