2. The petitioner seeks bail in connection with Bibhutipur P.S. Case No. 432 of 2022 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 14.07.2023 in Cr. Misc. No. 41694 of 2023.

4. As per the FIR, the petitioner is one of the assailants of the deceased.

5. It has been submitted by the learned counsel for the petitioner that the informant is not the eyewitness of the occurrence and she was told by her deceased husband that this petitioner along with others assaulted him and thereafter, he

6. It has further been submitted by learned counsel for the petitioner that six witnesses have already been examined.

7. Considering the fact that the trial is going on, I am not inclined to grant bail to the petitioner.
