2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 30 (a) of the Bihar Prohibition and Excise Act, 2022.

3. The case of the prosecution is that altogether 414 liters of Nepali foreign liquor and was recovered from an 'Orchard'.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner. It is also submitted that the petitioner was not

Patna High Court CR. MISC. No.63265 of 2025(2) dt.22-09-2025 2/2 apprehended on the spot. It is further submitted that the petitioner has one criminal antecedents of similar nature, Moreover, the petitioner has been languishing in Judicial custody since 08.07.2025.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khajauli P.S. Case No. 06 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise , Madhubani, with a condition that the petitioner shall not indulge in similar offence in future.
