It is submitted that petitioner has been granted anticipatory bail on 13.11.2017 but, inadvertently, due to mistake in place of bail order, following order has been typed "As prayed for put up this case on 13.11.2017." Therefore, the order dated 13.11.2017 may be modified.
In view of the submission, order dated 13.11.2017 is rescinded and following order is being passed; Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application, for grant of anticipatory bail, arises out of C.B.I. Case RC-3A of 2013/ Tr. No. 20 of 2017, disclosing offences under Sections 420, 468 and 471 of the Indian Penal Code.
Patna High Court Cr.Misc. No.38485 of 2017 (12) dt.16-11-2017 Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be lady was appointed on the post of Gramin Dak Sewak after due verification of her certificates but the said certificates were found forge and fabricated in the inquiry conducted by the Additional Superintendent of Police, C.B.I. ACB, Patna. Learned counsel for the petitioner further submitted that the petitioner is a pregnant lady and prays for sympathetic consideration of this Court.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, C.B.I.-II, Muzaffarpur, in connection with C.B.I. Case No. RC 03A/2013/ Tr. No. 20 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
