Case No. 54 of 2019, dated 25.02.2019, instituted for the offences under Section 394 of the Indian Penal Code.

The name of the petitioners has transpired in the confession of an arrested accused person. However, the looted mobile of the owner of the vehicle, which was

Mr. Akhauri Kamal Kishore Sahay, learned counsel for the petitioners has drawn the attention of this Court to the averments made in the F.I.R., wherein there is no statement with respect to snatching of the mobile phone of the driver or the owner of the vehicle. It has further been submitted that the petitioners have also not been put on test identification parade.

Prior to the implication of the petitioners in the present case, there was no case pending against them. Only after their arrest in the present case, they have been made accused in another case of similar nature but they are on bail in the aforesaid case.

Regard being had to the aforesaid facts and the period of custody of the petitioners which is from 29.05.2019, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial
