2. The petitioner has preferred this application for grant of regular bail in connection with Harnaut P.S. Case No. 243 of 2023 dated 28.04.2023 registered for the offences punishable u/ss 147, 148, 149, 341, 323, 379, 427, 504 and 506 of the Indian Penal Code and u/s 27 of the Arms Act.

3. As per the prosecution case, the petitioner came to the house of the informant and said that he partitioned his land among his four sons but no share was given to him. Thereafter, the petitioner and the informant's sons along with other unknown persons assaulted the informant and his nephew. On hulla, villagers came there then the petitioner and the

It is further alleged that they took Rs. 51,000/- from his cash box, jewellery and damaged the mobile of his nephew. Thereafter, the informant and his nephew were taken to the hospital for treatment.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner and the petitioner has no concern with the alleged offence. The petitioner is accused in five other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 08.06.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bihar Sharif, Nalanda in connection with Harnaut P.S. Case No. 243 of 2023 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below
