JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 457, 380 and 411 of the Indian Penal Code. Allegation against petitioner is that he took away the motorcycle of brother-in-law of informant.

It has been submitted on behalf of petitioner that he is in custody since 27.6.2016. He has got no criminal antecedent. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. The alleged occurrence is said to have taken place on 24.6.2016 and the case was instituted on 26.6.2016. Delay has not been explained by the prosecution. There is no seizure list to support the allegation made in the F.I.R.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.52631 of 2016 (2) dt.08-12-2016 2/2 amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Araria, in connection with Jokihat (Mahalgaon) P.S. Case no. 197 of 2016.
