JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Special Case No. 49 of 2016 arising out of vigilance P.S. Case No. 107 of 2016 registered for the offence punishable under sections 420, 467, 468, 471, 472, 477A, 409/120B of the Indian Penal Code as well as under section 13(2) read with section 13(1)(d) of Prevention of Corruption Act, 1988.
Learned counsels appearing for the petitioner submits that similarly situated co-accused has been granted bail by this Court vide order dated 27.07.2017 passed in Cr. Misc. No. 25927 of 2017.
Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the
Patna High Court Cr.Misc. No.37051 of 2017(3) dt.04-09-2017 2/2 petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance, North bihar, Muzaffarpur in connection with Vigilance P.S. Case No. 107 of 2016 corresponding to Special Case No. 49 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
