The petitioner being member of the family of the husband of the victim, is facing prosecution under section 304(B), 201/34 of the Indian Penal Code vide Meenapur P.S. Case No. 321 of 2013 lodged by the father of the victim in which the allegation is that within few months of marriage, the victim was tortured on account of non-fulfilment of demand of dowry and was done to death in a very suspicious circumstances while she was in sasural inasmuch as the dead body was disposed of.

Contention of the petitioner is that there is no eye witness to the occurrence. The petitioner is not directly responsible for the death of the daughter of the informant.

Learned counsel for the State points out that apart from the

Patna High Court Cr.Misc. No.53892 of 2016 (2) dt.20-12-2016 2/2 fact that he is named accused, there is inordinate delay in approaching this Court for grant of bail.

Considering the seriousness of the allegation and other materials reflected from the record, I am not persuaded to extent the privilege of anticipatory bail to the petitioner. Prayer is rejected.
