2. The petitioner seeks regular bail in connection with Sarari Ranjan P.S. Case No. 51 of 2025 registered for the offence under Sections 303(2), 334(1), 317(2) &3(2) of the B.N.S., 2023.
3. As per the prosecution case, the petitioner is accused of committing theft of mobile phone from the shop.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 16.05.2025.
5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.63497 of 2025(2) dt.17-09-2025 2/2 and the nature of the offence, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Samastipur/concerned Court below in connection with Sarari Ranjan P.S. Case No. 51 of 2025subject to condition that:- "(i) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.
(ii) The petitioner will mark his attendance at the Waligaon Police Station on the every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner."
