JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This application, for grant of anticipatory bail, arises out of Bikramganj P.S. Case No. 134 of 2018, disclosing offences under Section 30(A) of Bihar Excise Prohibition and Excise Act.
Prosecution case is that police received information that one motorcycle met with accident with one pick-up Van, on which, the police went there and recovered liquor from the motorcycle and petitioner and one co-accused has been named in the F.I.R.
Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case only on the basis of suspicion and there is no material against him, whereas, the owner of the motorcycle has been granted the privilege of anticipatory bail by a
Patna High Court CR. MISC. No.61016 of 2019(2) dt.25-09-2019 2/2 coordinate Bench of this Court vide order dated 18.09.2018 passed in Cr. Misc. No. 58458 of 2018.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 02nd Additional District & Sessions Judge -cum - Special Judge, Excise, Rohtas at Sasaram, in connection with Bikramganj P.S.
