JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This is an application for grant of anticipatory bail in connection with Khagaria P. S. Case No. 516 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Petitioners are named in the F.I.R. The F.I.R. disclosed that on seeing the police party, two persons including the petitioners started in fleeing away and on search of the field, there is recovery of 220 pouches of 200 ml each of illicit liquor and seizure list was prepared.

Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case. Nothing has been recovered from his house or from his field and F.I.R. disclosed that police identified the petitioners. Further

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Special Court (Excise)-cum- Additional Sessions JudgeII, Khagaria, in connection with Khagaria P. S. Case No. 516 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
