JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 05-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

In the night of 05.08.2013, accused persons, so named, including petitioners along with 25 unknown persons armed variously raided the house of the informant and others, committed loot, assaulted and made indiscriminate firing in the air. It has also been disclosed that on an order of Yodha Rai, petitioners along with Sheojee Sah took away belongings of the informant as well as cash appertaining to Rs.3,000/-. Adeya Rai attempted to stripe her over which she raised alarm when Deyadin, Sukhiya Devi came her house, Shambhu Sah (petitioner) pointed pistol at her and threatened. Jagranath Rai also pointed pistol towards her. They have also assaulted with lathi and Fatta.

Patna High Court Cr.Misc. No.58446 of 2015 (02) dt.05-02-2016 Considering the nature of the allegation in consonance with period of detention since 19.09.2015, petitioners, Shambhu Sah and Sabha Rai are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikarahana at Dhaka, East Champaran in connection with Ghorasahan (Lakhaura) P. S. Case no.294 of 2013.
