2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 364 and 34 of the Indian Penal Code.

3. It is a case of abduction of the informant's wife by the petitioner along with other accused persons.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case due to previous enmity and land dispute between father of the petitioner and informant. Neither the petitioner is named in the F.I.R. nor any witness has seen him at the alleged place of occurrence. He has not involved in the present occurrence in any manner. His name has been dragged in this case on the basis of statement of victim

Patna High Court CR. MISC. No.64777 of 2023(3) dt.15-12-2023 2/2 recorded u/s 164 of the Cr.P.C. in the instruction of informant. In fact, the victim is a lady of easy virtue and she fled away with her facebook friend namely, Rohit Kumar Sah (co-accused) at Pune where she was recovered. Moreover, the co-accused Manish Kumar Singh @ Bishwajit Singh who is father of the petitioner has already been granted bail by another co-ordinate Bench of this Court vide order dated 29.11.2023 passed in Cr. Misc. No. 74477 of 2023. Petitioner is languishing in judicial custody since 30.06.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Garkha P.S. Case No. 177 of 2023.
