The Petitioner apprehends his arrest in Halsi P.S. Case No.89 of 2016 instituted for the offence under Section(s) 341, 323, 307, 354, 452, 380, 504/34 Indian Penal Code. It is alleged against this petitioner that he along with one Pravesh Yadav caught the hair of the informant and pushed her down and assaulted with fists and slaps. It is further alleged that the accused persons also assaulted the daughter-in-law of the informant, Usha Devi, with fists, legs etc. Accused Lal Deo Yadav assaulted the daughter-in-law with lathi with intention to kill her, which she saved with her hand and sustained injury on her hand. It is alleged that on account of severe assault in her hand, her bangles got broken and she sustained injury. There is
Patna High Court Cr.Misc. No.56 of 2017 (2) dt.10-01-2017 2/2 no specific overt act against this petitioner. This petitioner is alleged to have caught hold the hair of the informant and pushed her down, which is mentioned in the written report itself. It is further submitted that earlier to this case Lal Deo Yadav had filed a case against the son of the informant and others vide Halsi P.S. Case No.56 of 2015 and the present complaint was filed as counter blast by the informant which was initially sent to the P.S. under Section 156(3) Cr. P. C. For the aforesaid reason, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Halsi P.S. Case No.89 of 2016, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Rajendra Das, Judicial Magistrate, 1st class, Lakhisarai, subject to the conditions as laid down under Section 438(2) Cr. P. C.
