JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 08-01-2016 After some argument, learned counsel appearing on behalf of the petitioner seeks permission to withdraw the present writ petition with a liberty to approach the appellate authority as provided under Section 14 of The Bihar Land Disputes Resolution Act, 2009 ( In short 'Act, 2009') for redressal of his valid grievances with respect to the lands claimed by the petitioner as also with respect to the impugned order dated 20.10.2012 passed in Land Dispute Resolution Case No. 11 of 2012 by the respondent D.C.L.R., Tekari, Gaya, as contained in Annexure-1 to the writ petition.
Permission is accorded.
The writ petition stands dismissed as withdrawn with the liberty aforesaid.
If an appropriate appeal is filed on behalf of the petitioner under Section 14 of the Act, 2009 within a period of three weeks from today with a certified copy of the present order and if it is found to have become barred by limitation and if any
Patna High Court CWJC No.24806 of 2013 (2) dt.08-01-2016 2/2 petition is filed on behalf of the petitioner for condonation of such delay, then the appellate authority shall take into consideration that on a bonafide legal advice, the present writ petition was filed before this Court on 11.12.2013 and that remained pending till date.
