The petitioner is apprehending his arrest in connection with Barachatti P.S.Case No.108 of 2016, registered for offences punishable under Sections 15/18 of N.D.P.S. Act. Allegation against the petitioner is of cultivation of opium plant in his field.
Submission of the learned counsel for the petitioner is that nothing has been recovered from the petitioner of the petitioner and he has been falsely implicated in this case. Heard learned A.P.P. also.
Having heard both sides and in view of the fact that the FIR shows recovery of opium plant from the field of the petitioner, I am not inclined to grant anticipatory bail to the petitioner,
Patna High Court Cr.Misc. No.36607 of 2017 (2) dt.11-08-2017 2/2 however, the petitioner is directed to surrender before the learned court below within a period of four weeks and make prayer for regular bail, which will be considered by the learned court below on his own satisfaction without being prejudiced by the order of this Court, if possible on the same day.
With the aforesaid observation, this application is dismissed.
